Basque Center for Macromolecular Design and Engineering, POLYMAT Fundazioa henceforth POLYMAT, seeks to maintain a culture of integrity and legal compliance and has therefore developed an effective Organization and Management Model which applies to the whole organization and shows its commitment to compliance with applicable law.
POLYMAT's management applies through example, and ensures that others apply, the organization's core values, standards of corporate governance, ethics and relations with all stakeholders defined in this manual or in the established Organization and Management Model as a whole.
Organic Law Nº 5/2010 of 22 June amending Organic Law Nº 10/1995 of 23 November of the Penal Code ("LO 5/2010"), introduces for the first time in the Penal Code an express regulation of the criminal liability of legal persons for crimes committed in their name by representatives, de facto or de jure administrators, workers and/or employees.
Likewise, reform of Organic Law Nº 10/1995 was passed on 11 March 2015 and published in the Official Gazette of the Spanish Parliament (las Cortes Generales) on 23 March 2015, with effect from 1 July 2015.
One of the changes included in this Reform is the existence of various extenuating and mitigating circumstances for the legal person, where so-called crime prevention models or programmes play a key role in exemption of criminal liability.
Therefore, the POLYMAT Board of Trustees, as the highest management body of the organization, has adopted and implemented the Organization and Management Model which includes the appropriate supervision and control measures to prevent or significantly reduce the risk of crimes being committed within the organization, including approval of this Criminal Risk Prevention Manual on the date shown on the cover.
With this Organization and Management Model and through its approval at the Board meeting, the Board, as the highest management body of POLYMAT, seeks to go a step further in its commitment to improvement, which began with the Implementation of the European Charter for Researchers & the Code of Conduct for the Recruitment of Researchers and thus increase its level of standards in terms of integrity and professionalism when carrying out our activity.
On 4 July 2017, POLYMAT was awarded the HR Excellence in Research stamp promoted by the European Commission through EUROAXESS for the development of human resources strategies in the research environment. The "HR Excellence in Research" stamp is an internationally recognised award.
